(Name of Breeder)                                                                                                               Here in after referred to as “Breeder” has agreed to sell the puppy(s) as listed on Page 1 and Page 2 of this agreement to 

(Name of Original Buyer)                                                                                                                        referred to as “Buyer” in this agreement.

 

1. This puppy(s) is a purebred Bernese Mountain Dog, which exhibits the typical temperament and confirmation, and embodies the basic standards of the Bernese Mountain Dog. The Breeder has made every effort to raise and deliver said puppy(s) to the Buyer in healthy condition.

2. The puppy(s) will go home with the necessary papers for the Buyer to complete their AKC limited registration, which does not include any breeding rights. Also a small bag of puppy food that the puppy(s) is currently eating, any necessary vet papers pertaining to the health care of the puppy, and a well-fitting collar and leash will be included with the puppy(s) purchase.

3. The puppy(s) received wormer at 2 weeks, 4 weeks, and 6 weeks of age, as prescribed by a licensed veterinarian. The puppy(s) will also be examined by a licensed veterinarian before being sent home, and will come with a clean bill of health from the vet, along with proof of age appropriate vaccinations.

4. While all puppies produced will exhibit the traditional tri-color Bernese Mountain dog color (black base with rust and white markings), the Breeder cannot make any warranty in respect to size, coat quality, length of hair, temperament, look of dog, ability to win a show, housebreak or reproduce.

5.  The puppy(s) is guaranteed against all communicable diseases for 24 hours (which include, but not limited to, Canine Distemper, Parvovirus, Canine Corona Virus, Canine Influenza, any external parasite including ticks, fleas or mange, any fungal infections, intestinal parasites, kennel cough, or ringworm).  The buyer is encouraged to have their puppy(s) examined by a licensed veterinarian within 5 days of purchase. IF the buyer does not take the puppy(s) to a licensed veterinarian within that time period, the puppy(s) is then considered accepted “as is” at the time of the sale, and no other legal action can be taken against the Breeder if the puppy(s) become unhealthy or dies. Under no circumstanced with the Breeder be responsible for any vet bills.

6. The Breeder does not guarantee against any non-life threatening conditions including, but not limited to trachea problems, luxating patellas, descending testicles, retaining baby teeth, bite issues, Open Frontanel, liver shunt and hernias.

7. A replacement puppy will only be given if the puppy is discovered to have a genetic or hereditary problem before the puppy(s)’ 6 month birthday, not due to any accident or any illness and/or death. The illness must be documented in writing by a licensed veterinarian. The Buyer then has 48 hours to inform the Breeder of the examination with proper documentation provided by a licensed veterinarian. If the puppy(s) was not fit for purchase, a replacement puppy will be given of comparable value (subject to availability) and no money will be refunded. Failure to do this within the 48 hour window and before the puppy(s) 6month birthday will result in the cancellation of the replacement puppy.

8. The Breeder is not responsible for any puppy’s death due to neglect.

9. If the Buyer for any reason can no longer keep or care for the puppy(s), the Buyer must give the Breeder first right of refusal. The Breeder has the choice to either take the puppy(s) back without any type or refund, or if the Breeder is unable to take the puppy(s) back at that time, the Buyer will commit to finding another home for the puppy(s) that does not include a pet shop, puppy mill, or to be used for scientific research.

10. Other than stated above (in #7), all sales are final and no money will be returned.

11. Any and all photos sent to the Breeder can be used to post to social media accounts or the Breeder’s official website.
